Scope of Work Detail does not include the cost of any concealed or unknown rotted, damaged or deteriorated wood unless
specifically stated in the Additional Work / Terms / Notes section contained herein. The cost for curing any wood
related issues is stated in the Scope of Work Detail above. Pictures will be taken of any wood to be replaced or fixed
for Client review upon request. The total of any extra charges will be added to the final bill and made a part of this
agreement.
Client is responsible to pay for any and all rotten wood. Per Florida Building Code, any and all rotten wood must be replaced.

Warranty
This document warrants that should a defect in workmanship, related to the work completed by West Star Roofing Solutions,
occur within ten (10) years of the project, West Star Roofing Solutions will complete repairs within the original project’s
scope of work at no charge to the customer.
This warranty does not cover normal wear and tear, hail damage, wind damage, sun damage, intentional or accidental
damage by any person, or acts of God that may or may not merit an insurance claim.
This warranty only applies to portions of the project in which West Star Roofing Solutions fully replaced any existing
products, and does not cover repairs or service done to another contractor’s work.
Defects in the building materials used to complete work do not fall under the scope of this workmanship warranty; any
building products installed will instead be covered by the product’s original manufacturer warranty.
Contractor’s work will be warranted by Contractor in accordance with its standard warranty. The acceptance of this
Contract by the Client(s) shall be and is the exclusive remedy against Contractor pertaining to the work of the Contractor.
All guarantees and warranties are valid only upon Payment in full, be it to the Contractor or manufacturer.
Where Contractor’s own forces perform any work, Contractor warrants that all Materials and equipment included in such
work will be new, unless otherwise specified.
Client(s) understands and acknowledges that Contractor does not warrant or guarantee previous workmanship or
pre-existing Materials, nor any Materials or Labor not originally provided by Contractor.
Contractor shall not be responsible for latent defects in Materials and accessories supplied.
Contractor shall not be responsible for rework required as a result of the acts or errors of others.
Contractor reserves the right to Subcontract any portion of this Contract, at Contractor’s sole discretion, within the scope
of any and all licenses held by same.
The responsibility and liability of Contractor is strictly limited to things that can be controlled and reasonably foreseen
by Contractor; however, Contractor will not be liable for the acts or omissions of Subcontractors or any other party.
No other warranty is expressed or implied unless accompanied with this Contract, signed by all Parties, and marked as
an Exhibit.
If Contractor is not paid in full in accordance with this Contract, all warranties are null and void.
Any warranties expressed in this Contract are not transferable to a new Property Owner.
Terms and Conditions
This Contract between West Star Roofing Solutions (hereafter referred to as “Contractor”) and the Client(s) (hereafter
referred to as “Client(s)”) will be subject to all appropriate laws, regulations and ordinances as well as the following
special Terms and Conditions:
BINDING: This Contract shall not be binding on Contractor or Client until approved by Financial Company or
Contractor’s Credit and Production Departments in their respective workflows. If Client has filed an insurance claim for
the roof then the Contractor agrees to perform all work for the fee stated in the agreement or for the amount listed in
the Insurance Settlement whichever is less provided that a complete roof replacement has been approved. Contractor
also has the right to file for supplements if the Insurance Settlement is missing items.
GENERAL: Types of Replacement Roofing Materials furnished by Contractor are: (i) Metal; (ii) Asphalt Shingle; and (iii)
TPO, all of which come in various colors and styles. However, Client(s) Material selections may not be in-stock or
immediately available to complete installation.
SCOPE OF WORK: Contractor will: (i) remove existing exposed Roof system; (ii) inspect wood decking for possible
defects or damages; (iii) take photos; and (iv) for an additional cost, replace any concealed damages to the Roof
decking or substructure lumber. See Woodwork definition for cost explanation. Unless otherwise specifically noted,
Contractor shall provide and pay for all Labor, Materials, equipment, tools, machinery, transportation, and other
facilities and Services necessary for the proper execution and completion of the Work. Upon completion, a Code
Enforcement Authority will perform a Final Inspection of the Work and issue certification that installation meets or
exceeds code requirements.
ADDITIONAL CHARGES: Contractor is not responsible for unknown Conditions that cannot be observed in a
non-destructive Inspection of the premises or Conditions that differ Materially from those indicated or referred to in
the Contract documents. Any hidden, concealed, or unforeseeable Conditions that must be repaired, corrected,
replaced, or overcome, shall result in additional charges which shall be the sole obligation of the Client(s) to pay
immediately following completion of installation.
WOODWORK: Wood Repair or Replacement that is necessary within the Scope of Work, pursuant to §553, or deemed
by Contractor or any Code Enforcement Authority, Woodwork will be billed at $100.00 per ½ inch sheet of plywood;
$125.00 per ¾ inch sheet of plywood; framing lumber and any other wood will be billed at $10.00 per linear foot for 1x6
and 1x8; $6.00 per linear foot 1x3; $5.00 per linear foot for 1x2. Painting is not included and will incur an additional
charge to Client(s).
EXTRA LAYERS: Any additional layer of shingles, or roofing material past first layer is an additional charge of $10.00 per
Square.
PAYMENT: Pursuant to §715.12, Florida Statutes, Payment is promptly required, including Payment for all Change
Orders and/or Supplements. If Client(s) does not pay Contractor the Payments specified under the Terms of this
Contract, the Contractor may stop the Work until Payment of the amount owing has been received. In such event, the
Contract Price shall be increased by the amount of the Contractor’s reasonable costs of shut-down, delay, and start-up.
Contractor has no obligation to continue from one job phase to another job phase until Payment of the completed job
phase(s) is received.
INTEREST: If Client(s) defaults in the Payment under the Terms of this Contract, interest shall be added from the date
thereof at a rate of one and one-half (1.5%) per month (18% per annum).
LIEN RIGHTS: In order to secure Payment for all such parts, labor, materials, supplies, work and services, Contractor is
hereby granted an express mechanics Lien per §713, Florida Statutes.
COMMENCEMENT: Contractor shall commence the work contemplated herein, within 90 days, unless mutually agreed
to otherwise. Commencement may be delayed by up to 180 days in the event of a Force Majeure scenario or
circumstance.
DUMPSTER & MATERIAL DELIVERY: Contractor will have the Roofing Materials delivered to Client(s) Property and a
dumpster will be placed nearby to dispose of the existing Roof Materials.
MATERIALS: Contractor has the right to order excess Material. All excess Materials belong to Contractor.
COLORS: Contractor does not guarantee exact color match.
UTILITIES: Client(s) is responsible for utilities required for completion of the work.
WORK ENVIRONMENT: The worksite is inherently dangerous. Client(s) agree not to enter the work environment.
FINAL INSPECTION AND CLEAN UP: Contractor will perform final clean-up and magnetic sweep.
NOTICE OF COMMENCEMENT & PERMITTING LIMITED POWER OF ATTORNEY:
Homeowner hereby authorizes West Star Roofing Solutions and its designated agents to act as their Authorized
Representative for permitting purposes.
INDEMNIFICATION, CLAIMS, RIGHT TO CURE, ENTIRETY, VALIDITY, FORCE MAJEURE, LAW, VENUE, FEES,
CONSTRUCTION LIEN LAW, AND RECOVERY FUND provisions apply pursuant to Florida law.
